Terms and Conditions of Sale

1. Seller identification
These Terms and Conditions of Sale govern all purchases made on www.barbaracamagno.com, operated by Barbara Camagno, Rue Edouard Dekoster 57b, 1140 Evere, Belgium, VAT number BE1035484601, business registration number 1035484601. Contact: contact@barbaracamagno.com.
2. Products
We sell original, limited-availability artworks (“the Artworks”) as described and depicted on the website. Each Artwork is a unique, handmade piece; minor variations in color or texture compared to photographs may occur due to display settings or the nature of the medium.
3. Prices
All prices are displayed in EUR and are final prices payable by the buyer. No VAT is charged, as the seller operates under the Belgian small enterprise VAT exemption scheme (Article 56bis of the Belgian VAT Code). Shipping within the EU customs territory is included in the displayed price. For destinations outside Europe, shipping is not included; please contact us before purchasing so we can provide an accurate shipping quote for your location.
4. Payment
Payment is processed securely through Squarespace Payments. We accept credit/debit cards. Your order is confirmed only once payment has been received in full.
5. Shipping and delivery
Estimated delivery times are indicated on the website or communicated by email after purchase. Shipments are sent via insured courier; risk of loss or damage to the Artwork during transit remains with the seller and transfers to the buyer only upon delivery of the Artwork. If the Artwork arrives damaged, please notify us within 48 hours of delivery, with photos where possible, so we can file an insurance claim and arrange a replacement or refund. For shipments outside the EU customs territory, the buyer may be responsible for import duties, customs clearance, and local taxes upon arrival; these charges are determined by local customs authorities and are not included in the purchase price.
6. Right of withdrawal (EU consumers)
If you are a consumer residing in the European Union, you have the right to withdraw from your purchase within 14 calendar days from the day you (or a third party indicated by you) receive the Artwork, without giving any reason.
To exercise this right, you must inform us of your decision by a clear statement (e.g. by email to contact@barbaracamagno.com) before the 14-day period expires. The Artwork must be returned in its original condition and packaging within 14 days of notifying us, at your own cost. We will reimburse the full purchase price, including original delivery costs, within 14 days of receiving the returned Artwork or proof of return shipment, using the same payment method used for the original transaction. We may deduct from the reimbursement an amount corresponding to any diminished value of the Artwork resulting from handling other than what is necessary to establish its nature, characteristics, and condition.
Note: this right of withdrawal does not apply to Artworks made or customized specifically to a buyer's specifications, or that are clearly personalized.
7. Legal warranty
All Artworks are covered by the legal warranty of conformity applicable to consumer sales under Belgian and EU law. If an Artwork is defective or does not conform to its description, please contact us at contact@barbaracamagno.com.
8. Limitation of liability
We are not liable for indirect damages, loss of enjoyment, or third-party acts beyond our reasonable control. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
9. Governing law and disputes
These Terms are governed by Belgian law. Any dispute shall first be addressed amicably; failing resolution, it shall fall under the jurisdiction of the courts of Brussels, Belgium. EU consumers may also use the European Online Dispute Resolution platform:

10. Changes to these Terms
We may update these Terms and Conditions of Sale from time to time. The version applicable to your order is the one published on the website at the time of purchase.
